Delhi High Court Demands deposit as Shamshera’s OTT Release condition

Ranbir Kapoor Sanjay Dutt starrer Shamshera gets the Delhi HC nod subject to YRF depositing One Crore with its registration.

In a recent judgement the Delhi High Court allowed the release of Ranbir Kapoor’s movie Shamshera. However the court also asked the makers YRF to deposit One Crore with its registry. Justice Jyoti Singh passed the order that breached the copyright work ‘Kabu na chhadein Khet. Movie released in the theatre last month and was supposed to hit the OTT platforms on this Friday. Court had asked to deposit the money by 22nd, else the movie will be issued warning from August 23rd. Considering the above the movie Shamshera’s OTT Release condition the court passed the verdict.

High Court asks YRF to deposit 1 crore as registry, passes a verdict

The plaintiff had earlier objected to the release of the movie on OTT as there was a clear violation of the copyright. Not only there had been a significant amount of work is reproduced, but also there is an open lack of trust. The filmmakers had urged the court to allow the permission of the movie, else it would lead to breach of contractual obligations of the third parties. Also they said that the damages would be irreparable and urged the court to allow the plaintiff be given money too.

“Considering the totality of the circumstances as well as the fact that the impugned film has already been released in theatres and is scheduled to be released on the OTT Platforms tomorrow i.e. 19.08.2022, in my view, in order to balance the equities between the parties, at this stage, it would be appropriate to permit Defendant No. 1 to release the impugned film “Shamshera”, on the OTT Platforms, subject, however, to Defendant No. 1 (Yash Raj Films Pvt Ltd) depositing a sum of Rs.1 Crore with the Registrar General of this Court, latest by 22.08.2022,” the court said.”

“It is made clear that if the money is not deposited within the timeline granted by this Court, an injunction shall operate against the further telecast of the movie on the OTT Platforms with effect from 23.08.2022. Needless to state, the deposit is without prejudice to the rights and contentions of the parties to the lis and is only to balance the equities at this stage,” it added.

Considering Shamshera is already disputed for copyright and there are many things at stake, the court asks YRF to deposit depositing a sum of Rs.1 Crore with the Registrar General of this Court, latest by 22.08.2022,” the court said.
